Nevada Personal Injury Law: What Las Vegas Accident Victims Need to Know

Nevada law is different from California law in ways that directly affect your claim. These are the rules that matter most in a Las Vegas injury case:

  • Two-year deadline. Under NRS 11.190(4)(e), a personal injury lawsuit generally must be filed within two years of the injury. Claims against Nevada state or local government entities follow special notice rules and a damages cap under NRS 41.031–41.039, so act quickly.
  • Modified comparative negligence (the 51% bar). Under NRS 41.141, you can recover as long as your share of fault is 50% or less; your award is reduced by your percentage of fault. If you are found 51% or more at fault, you recover nothing. California, by contrast, uses pure comparative negligence.
  • Minimum auto insurance is low. Nevada requires only $25,000 per person / $50,000 per accident for bodily injury and $20,000 for property damage (NRS 485.185). Many Las Vegas drivers carry these minimums, so we check every policy, including your own uninsured/underinsured motorist (UM/UIM) coverage.
  • Where your case is heard. Injury lawsuits in Las Vegas are filed in the Eighth Judicial District Court (Clark County) at the Regional Justice Center, 200 Lewis Avenue; smaller claims may be filed in Las Vegas Justice Court.
  • Crash reports. Collisions inside the city are usually handled by the Las Vegas Metropolitan Police Department (LVMPD); crashes on I-15, US-95 and the I-215 Beltway are typically investigated by the Nevada Highway Patrol. We obtain the report and the body-camera and traffic-camera evidence for you.

Las Vegas Injury Cases We Handle

Car Accidents

Crashes on I-15, US-95, the I-215 Beltway, Boulder Highway and Las Vegas Boulevard (the Strip), including tourist-rental and out-of-state driver cases.

Rideshare Accidents

Uber and Lyft collisions to and from Harry Reid International Airport and the Strip, including the larger commercial rideshare insurance that applies while a ride is in progress.

Truck Accidents

Commercial truck crashes on the I-15 corridor between Las Vegas and Southern California, governed by federal FMCSA rules.

Motorcycle Accidents

Nevada requires helmets for all riders (NRS 486.231); we counter insurers who blame the rider.

Pedestrian Accidents

Crosswalk and Strip-area pedestrian collisions, one of Clark County’s most common serious-injury crashes.

Casino & Hotel Slip and Falls

Premises liability claims against resorts, casinos, parking structures and retail centers that fail to fix or warn about hazards.

Wrongful Death

Claims by spouses, children, parents and the estate under NRS 41.085 after a fatal accident.

Brain & Catastrophic Injuries

Traumatic brain injury, spinal cord injury and burn cases requiring life-care planning and expert testimony.

What to Do After an Accident in Las Vegas

1. Get medical care

Go to the ER or urgent care even if you feel fine. University Medical Center (Nevada’s only Level I trauma center) and Sunrise Hospital treat most serious Las Vegas crash injuries. Gaps in treatment are used against you.

2. Report the crash

Call 911 so LVMPD or the Nevada Highway Patrol documents the scene. Get the report number, the other driver’s insurance, and photos of vehicles, injuries and road conditions.

3. Preserve evidence

Casinos, resorts and rideshare companies keep video and data for a short time. We send preservation letters immediately so the footage and telematics are not erased.

4. Don’t give a recorded statement

You are not required to speak to the other driver’s insurer. Refer them to us; anything you say can be used to shift fault to you under Nevada’s 51% rule.

Why Choose Bedford Law Group in Las Vegas

  • Licensed in Nevada and California. Many Las Vegas crashes involve California drivers, rental cars or out-of-state insurers. One firm can handle both sides of the state line.
  • More than 20 years of personal injury work. Shawn Azizzadeh, Esq. has represented injury victims since 2003 and has recovered over $100 million in verdicts and settlements.
  • No fee unless we win. We work on a contingency fee: no upfront cost, and our fee comes out of the recovery under a written fee agreement.
  • A Las Vegas office minutes from the Strip. Meet us at 3753 Howard Hughes Parkway or by video, and reach the attorney directly, not a call center.

Las Vegas Personal Injury FAQs

How long do I have to file a personal injury lawsuit in Las Vegas?

In Nevada you generally have two years from the date of injury to file a lawsuit under NRS 11.190(4)(e). Claims against a city, county or state agency have additional notice requirements under NRS 41.031–41.039. Because evidence such as casino video is erased quickly, contact a lawyer well before the deadline.

What if I was partly at fault for my Las Vegas accident?

Nevada follows modified comparative negligence under NRS 41.141. You can still recover if your share of fault is 50% or less, but your compensation is reduced by that percentage. If a jury finds you 51% or more at fault, you recover nothing, which is why insurers try hard to shift blame onto the injured person.

How much does a Las Vegas personal injury lawyer cost?

Bedford Law Group works on a contingency fee. The consultation is free, there is no upfront cost, and the attorney fee is a percentage of the money we recover for you, set out in a written fee agreement before we start. If there is no recovery, you owe no attorney fee.

Is Shawn Azizzadeh licensed to practice law in Nevada?

Yes. Shawn Azizzadeh, Esq. is licensed to practice law in Nevada and in California, and Bedford Law Group maintains a Las Vegas office at 3753 Howard Hughes Parkway, Suite 200-1310, Las Vegas, NV 89169, in addition to its main office in Los Angeles.

What are Nevada’s minimum car insurance limits?

Nevada’s minimum liability limits are $25,000 per person and $50,000 per accident for bodily injury, plus $20,000 for property damage (NRS 485.185). Serious injuries often exceed these limits, so we also pursue underinsured motorist coverage, umbrella policies and any commercial or rideshare policies that apply.

How do I get my Las Vegas accident report?

Crash reports for collisions inside Las Vegas are issued by the Las Vegas Metropolitan Police Department’s records section, and reports for crashes on the interstates and highways come from the Nevada Highway Patrol. Give us the report number or the date and location of the crash and we will obtain the report for you.

I was hurt while visiting Las Vegas but live in California. Which law applies?

Nevada law usually governs an accident that happens in Nevada, including its two-year deadline and 51% comparative-fault rule, even if you live in California. Because Bedford Law Group is licensed in both states, we can handle the Nevada claim while you treat and recover at home in California.
